TERMS OF BUSINESS

STUDIO HIRE TERMS OF BUSINESS

These Terms and Conditions will govern the contract formed between Kickback Studio and the Customer for the hire of the Studio for rehearsals, live streaming, recording sessions, drum lessons, miscellaneous hire and equipment hire, and shall apply to the exclusion of any other terms that the Customer seeks to impose or incorporate, or which are implied by trade, custom, practice or course of dealing.

CANCELLATION

1. BUSINESS HOURS AND BOOKING TIMES

1a. Business hours are between 10am and 11pm, Monday to Sunday.

1b. Bookings times start as per confirmed time and if a Customer is late, booking fees are incurred from the agreed booking time.

2. BOOKING CONFIRMATION AND PAYMENT TERMS

 

2a. A booking is considered as confirmed after Kickback Studio receives cleared full balance payment. Email confirmation will be sent to the Customer. 

2b. Customers must make a full balance payment (including any agreed security deposit) upon booking, and failure to do so will result in termination of scheduled hire without refund or notice.

3. SET UP AND TAKE DOWN TIME

 

3a. Clients must include set up and take down/clean up time within the hours booked, to avoid overtime charges.

 4. CLEANING AND LEAVING THE STUDIO IN A REASONABLE STATE

 

4a. Studio or venue space must be left in a reasonable state at the end of clients booking to avoid additional cleaning charges (at the discretion of Kickback Studio).

 

 

5. USE OF EQUIPMENT

 

5a. If your booking comes with lighting, sound or other equipment, all equipment used must be returned promptly at the end of the hire period in the original condition, and the Customer is liable for repair or replacement cost for any missing or damaged equipment.

5b. Customers may not without the written consent of Kickback Studio; remove the equipment from the studio premises; modify or alter or tamper with the equipment in any way; use the equipment in a manner not recommended by the manufacturer; nor allow the equipment to be used by any untrained or unauthorised personnel.

5c. Any required equipment or studio booking add-ons must be requested and added to the booking in advance to ensure availability. We cannot guarantee the availability of any equipment where it has not been specifically requested, confirmed and added to your booking.

 

 

6. BREAKAGES, LOSSES AND DAMAGES

 

6a. Customers are responsible for any breakages, losses or damages caused to the premises or equipment by the Customer, or any other person(s) during booking time.

6b. All equipment used is at the risk of the Customer, and Kickback Studio shall not be liable to the Customer for any loss, damage, expense, or for any consequential loss (including loss of profit) arising out of or in connection with; any damage to or loss of property by the Customer or third party; any breakdown, stoppage or failure of the facilities/equipment provided by Kickback Studio.

6c. Alterations or an addition to our premises or equipment is not permitted without prior written consent.

6d. Customers must check any equipment provided and must notify Kickback Studio at the time of supply if equipment is damaged or if the condition of the equipment is not acceptable. The Customer is responsible for any breakages or damage if Kickback Studio was not notified at the time of supply.

 

 

7. RESCHEDULING AND CANCELLATION POLICY

 

7a. REHEARSAL SPACE HIRE:

• Booking times for rehearsal space hire can be rescheduled with a minimum of 24 hours notice from the start of the original booking time. If the studio hire booking is rescheduled with less than 24 hours notice, the Customer will be charged at full price.  

• Booking times for rehearsal space hire can be cancelled with a minimum of 24 hours notice from the start of the original booking time, and a full refund will be given to the Customer. If the studio hire booking is cancelled with less than 24 hours notice, the Customer will be charged full price.

7b. LIVE STREAMING SPACE HIRE:

• Booking times for live streaming space hire can be rescheduled with a minimum of 24 hours notice from the start of the original booking time. If the studio hire booking is rescheduled with less than 24 hours notice, the Customer will be charged at full price.  

• Booking times for live streaming space hire can be cancelled with a minimum of 24 hours notice from the start of the original booking time, and a full refund will be given to the Customer. If the studio hire booking is cancelled with less than 24 hours notice, the Customer will be charged full price.  

 

7c. RECORDING SESSIONS:

• Booking times for recording sessions can be rescheduled with a minimum of 72 hours notice from the start of the original booking time. If the recording session is rescheduled with 48 hours notice, the Customer will be charged at 50% of the price. If the recording session is rescheduled with less than 48 hours notice, the Customer will be charged at full price.

• Booking times for recording sessions can be cancelled with a minimum of 72 hours notice from the start of the original booking time, and a full refund will be given to the Customer. If the recording session is cancelled with 48 hours notice, the Customer will be charged at 50% of the price. If the recording session is cancelled with less than 48 hours notice, the Customer will be charged at full price.

 

7d. DRUM LESSONS:

• Booking times for drum lessons can be rescheduled with a minimum of 24 hours notice from the start of the original booking time. If the lesson is rescheduled with less than 24 hours notice, the Customer will be charged at full price.  

• Booking times for drum lessons can be cancelled with a minimum of 24 hours notice from the start of the original booking time, and a full refund will be given to the Customer. If the lesson is cancelled with less than 24 hours notice, the Customer will be charged full price.  

• The Customer will be charged full price for any missed or unattended drum lessons.

7e. MISCELLANEOUS SPACE HIRE:

• Booking times for miscellaneous space hire can be rescheduled with a minimum of 24 hours notice from the start of the original booking time. If the studio hire booking is rescheduled with less than 24 hours notice, the Customer will be charged at full price.  

• Booking times for miscellaneous space hire can be cancelled with a minimum of 24 hours notice from the start of the original booking time, and a full refund will be given to the Customer. If the studio hire booking is cancelled with less than 24 hours notice, the Customer will be charged full price.

8. TERMINATION

​

8a. Kickback Studio may terminate any booking or hire contract if the Customer is found to be in breach of any of the terms and conditions.

 

 

9. NOISE

​

9a. Speakers are provided and music can be played inside premises at a moderate and reasonable (at discretion of Kickback Studio). Noise levels outside of our premises must be kept to a reasonable level during bookings. Customers are asked to consider other occupants and neighbour residents when using our facilities.

9b. Music must be turned off by 11pm and noise levels must be minimised to a low and reasonable level after this time in order to not disrupt or cause inconvenience to nearby neighbours.

 

 

10. LITTERING AND WASTE DISPOSAL

 

10a. Clients must not litter and drop waste on the inside or outside of our premises, and must put all litter in the bins provided. Additional bin bags will be provided and clients are responsible for ensuring all waste is disposed off and outside spaces are kept clean and litter free. Failure to do so will result in additional charges.

 

 

11. VARIATIONS

11a. These Terms and Conditions are valid at time of booking and are subject to variation. It is the responsibility of the Customer to check this page periodically for changes. The Customer's continued use of or access to the website and use of the services offered by Kickback Studios constitutes acceptance of those changes.
 

 

12. APPLICABLE LAW

​

 12a. The laws of the United Kingdom shall govern all agreements.
